    Dr. Taitz,

    The second swearing in took place on 21 January 2009. Joe Biden performed it, I beleive without the Bible, at or near the White House. I hope this helps!

    The second swearing was done 2 days later by Roberts. It was done in the office without a bible.

    You are correct,
    Justice Roberts performed the second Swearing in the following day in the Oval Office and there was no news coverage other than that it did take place.

    I do not know the exact time.

    Makes one wonder what actually did happen on that day.

    “Are you ready to take the oath?” Mr. Roberts asked.

    “I am, and we are going to do it very slowly,” Mr. Obama replied.

    It happened at 7:35 p.m., with no mistakes, and took 25 seconds.

    Mr. Roberts said, “Congratulations, again.”

    Mr. Craig issued a statement a few minutes later.

    “We believe that the oath of office was administered effectively and that the President was sworn in appropriately yesterday. But the oath appears in the Constitution itself. And out of an abundance of caution, because there was one word out of sequence, Chief Justice Roberts administered the oath a second time.”

    The re-swearing in marks the third time in U.S. history for a president to do so. The other two were Presidents Calvin Coolidge and Chester A. Arthur.

    After President James Garfield was shot, President Arthur was sworn in at his home in New York. He took the oath a second time in a ceremony in Washington two days later with the chief justice of the United States.

    IT WAS MOST DEFINITELY THE NEXT DAY (the second day, being January 21, 2009, the day after the first — faulty — swearing), done in the Whitehouse by Judge Roberts (there were certainly news accounts, although I don’t recall without research the exact time).

    I remember watching on TV the second oath that Obama swore on the next day inside the White House with Roberts presenting with the Bible (or the black book like the Bible). The news reporter said that it didn’t happen very often but the last time was when Clinton had made the second oath too.

    At issue was the word “faithfully,” which Roberts misplaced after Obama interrupted him during the momentous occasion Tuesday, the News said. Constitutional law experts said the do-over probably wasn’t necessary but was done to avoid any gray area.

    There’s no formal name for what President Obama and Chief Justice John G. Roberts Jr. did last night.
    After flubbing his one role on Inauguration Day — administering the oath of office to Obama — Roberts traveled to the White House to re-administer the oath.
    Just to make sure.
    “We decided it was so much fun . . .,” Obama joked while sitting on a couch in the Map Room. Obama stood and walked over to make small talk with pool reporters as Roberts donned his black robe.
    “Are you ready to take the oath?” Roberts asked.
    “I am, and we’re going to do it very slowly,” Obama replied.
    After a flawless recitation that included no Bible and took 25 seconds, Roberts smiled and said, “Congratulations, again.”
    Obama said, “Thank you, sir,” and then added: “All right. The bad news for the [reporters] is there’s 12 more balls.”
    A president is required by the Constitution to say, “I do solemnly swear that I will faithfully execute the office of president of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”
    At the inauguration, Roberts instead said: “that I will execute the office of president to the United States faithfully.”
    In a statement, White House counsel Greg Craig said the oath was re-administered “out of an abundance of caution.”
    “We believe that the oath of office was administered effectively and that the President was sworn in appropriately yesterday. But the oath appears in the Constitution itself,” Craig’s statement said.

    …and because Chief Justice Roberts certainly must have been aware of BHO’s (admitted by virtue of Kenyan/British dad) ineligibility under Article 2 “natural born citizen”, Justice Roberts technically protected himself from giving the proper oath; in other words, technically (and actually) under the constitution Obama could not be POTUS so Roberts technically (and actually) did NOT give what was the Constitutionally prescribed Oath — and only did so the next day on Order from the Whitehouse (and I seem to recall from news accounts there were no witnesses in the room during the ‘second’ oath — although I may be wrong on that).

    Barack Obama has been sworn in as US president for the second time in two days, because one word was given out of order during Tuesday’s ceremony.

    The Chief Justice of the US Supreme Court, John Roberts, administered the oath again at the White House.

    The decision to repeat the oath was taken out of an abundance of caution, an official said.

    But Mr Obama joked: “We decided it was so much fun….” before adding: “We’re going to do it very slowly.”

    In contrast to the first oath-taking, Mr Obama did not swear on a Bible and his wife Michelle was not at his side.

    And instead of an audience of millions, only a few close aides saw the second attempt, with even journalists excluded from the Map Room of the White House.

    Tuesday’s stumble went largely unnoticed at the time.

    In the oath, as set out in the US Constitution, the new incumbent swears to “faithfully execute the office of president of the United States”.

    But as Chief Justice Roberts read out the oath for Mr Obama to repeat, he moved the word “faithfully” to the end of the phrase.

    Obama takes ‘erroneous’ oath

    Mr Obama, apparently noticing the error, hesitated. Mr Roberts repeated the phrase correctly, but Mr Obama went with the incorrect formula.

    “We believe the oath of office was administered effectively and that the president was sworn in appropriately,” said White House counsel Greg Craig.

    “Out of the abundance of caution, because there was one word out of sequence, Chief Justice John Roberts will administer the oath a second time.”

    Two other presidents, Calvin Coolidge and Chester Arthur, have had to repeat the oath because of similar problems.

    And Chief Justice William Taft introduced a new word into the oath when he swore in President Herbert Hoover in 1929, promising to “preserve, maintain and defend the Constitution”, instead of “preserve, protect and defend”.

    … and since GW Bush’s Presidency ended at noon on Jan 20, 2009, until the proper oath was given, Biden would have been acting President under the constitution.

    (Maybe Biden was in the room with Obama and Roberts for the second oath.)

    Of course, since your Keyes case is against Obama for tort fraud committed by CANDIDATE (not PRESIDENT) Obama, and was not part of scope of serving as a President anyway, it is well established that there’s no Presidential immunity (even if your suit were filed AFTER Obama took the Oath).

    A San Francisco Chronicle story today cites several constitutional scholars as saying President Barack Obama should retake his oath of office because of the misstatement of it by Chief Justice John Roberts. “In giving the oath, Roberts misplaced the word “faithfully,” at which point Obama paused quizzically. Roberts then corrected himself, but Obama repeated the words as Roberts initially said them.”

    This would not be a first according to the story. Both Presidents Calvin Coolidge and Chester Arthur did so under similar circumstances. Ironically, Chester Arthur was probably the first and only other president until Obama to skirt the constitutional requirement that a president be a natural born citizen. Arthur lied about his date of birth because his father had not yet become a U.S. citizen at the time of his birth, a fundamental requirement for being a natural born citizen.

    Obama’s father was a Kenyan citizen at the time of his birth and all times thereafter. Accordingly, he was born with dual citizenship and fails the natural born citizenship requirement. Obama also later became an Indonesian citizen after he was adopted by his step father, Lolo Soetoro. His name was legally changed to Barry Soetoro. It is unclear if or when his legal name was ever changed back to Barack Hussein Obama. I think the NBC issue is of a little more concern than whether the oath was properly recited word for word, but I’m not a Harvard law graduate like Obama and Roberts so what is my opinion worth. And what is the oath worth if the person reciting it didn’t use his actual legal name?

    UPDATE: Well, somebody at the White House took the concern seriously. Obama retook the ceremony in the Map Room of the White House:

    At 7:35 pm, Roberts administered the oath of office again to Obama in the Map Room. Robert Gibbs said the WH counsel, Greg Craig, believes the oath was fine Tuesday, but one word was out of sequence so they did this out of a “an abundance of caution.” “We decided it was so much fun…” Obama joked while sitting on a couch. Obama stood and walked over to make small talk with the pool as Roberts donned his black robe. “Are you ready to take the oath?” Roberts asked. “I am, and we’re going to do it very slowly,” Obama replied. Oath took 25 seconds. After a flawless recitation, Roberts smiled and said, “Congratulations, again.” Obama said, “Thank you, sir.” Smattering of applause. “All right.” Obama said. “The bad news for the pool is there’s 12 more balls.”

    The second oath — also administered by Roberts — took place at 7:35 p.m. Wednesday the 21st in the White House’s Map Room.

    I have no idea what “official docs” you are looking for. The oath appears to be completely oral, and no written oath is signed. So there are no documents at all.

    The chief justice administered the oath again to the President at 7:35 pm ET in the map room of the White House, according to a pool report released by the White House. No television cameras were there to witness the event, but the White House released a photo of Obama taking his second oath.

    It was the next day, January 21, 2009 at 7:35PM. There was NO BIBLE for the do-over, and the oath was administered by Roberts in the Map room.

    This is according to the pool report, as reported by ‘Politics Daily.’

    Chief Justice John G. Roberts Jr. re-administered the oath to Mr. Obama on Wednesday evening, one day after the two men stumbled over each other’s words during the inauguration ceremony at the Capitol.

    For their do-over, the two men convened in the White House Map Room at 7:35 p.m. for a brief proceeding that was not announced until it was completed successfully.

    “Are you ready to take the oath?” Chief Justice Roberts said.

    “I am,” Mr. Obama replied. “And we’re going to do it very slowly.”

    President Obama took the oath of office a second time Wednesday night during a private ceremony at the White House one day after the flubbing of the oath on Inauguration Day.

    Chief Justice John Roberts made a secret trip to the White House and, wearing his robe, readministered the oath to Mr. Obama.

    Twelve people were in the room, including the president. From the White House staff: White House Press Secretary Robert Gibbs, White House Counsel Greg Craig, senior adviser David Axelrod, and the official White House photographer.

    Mr. Gibbs told the small pool of reporters and White House staffers this was done to be cautious since there was “one word out of sequence” on Tuesday.

    “Are you ready to take the oath?” Mr. Roberts asked.

    “I am and we are going to do it very slowly,” Mr. Obama replied.

    It happened at 7:35 p.m., with no mistakes, and took 25 seconds.

    Mr. Roberts said, “Congratulations, again.”

    Mr. Craig issued a statement a few minutes later.

    “We believe that the oath of office was administered effectively and that the President was sworn in appropriately yesterday. But the oath appears in the Constitution itself. And out of an abundance of caution, because there was one word out of sequence, Chief Justice Roberts administered the oath a second time.”

    The re-swearing in makes it a third time in U.S. history for a president to do so. Former president Calvin Coolidge was one.

    After President James Garfield was shot, Chester Arthur was sworn in from his home in New York. He took the oath a second time in a ceremony in Washington two days later with the Supreme Court Justice.

    I found it – Fox noted in another article that Bloomberg News was one of the few reporters allowed at the 2nd swearing ceremony. Per Bloomberg’s article, the swearing in happened at 7:35 PM on WEDNESDAY (the day after the inauguration.) “Roberts went to the White House for the second swearing-in at 7:35 p.m. Washington time in the Map Room of the main residence.” Note also interesting precendents reported in the article: “Rogan Kersh, associate dean of New York University’s Wagner School of Public Service, said two presidents before Obama have repeated their swearing-in.” (See article for more. . .)

    Mr Obama’s likely reaction in the event of a backlash will be that he did not consider last night’s (Jan 21, 2009) oath to be the one that counts.

    On Tuesday, Mr Obama was sworn in with his left hand on the Bible used by his great political hero, Abraham Lincoln, on his first inauguration in 1861. That book was returned to the Library of Congress straight afterwards.

    It is not clear whether Mr Roberts, the Supreme Court Chief Justice, had been expected to bring a Bible with him but it might come as a shock to some of Mr Obama’s more devout supporters – he and his family are regular churchgoers – that no Bible was available last night and the ceremony went ahead without one.

    “The retaking of the oath went without a hitch and Obama was successfully sworn in, a second time, as president of the United States Of America. But this time he done it without his left hand on the bible,” reported the Atheist News weblog.

    “Obviously this is not that much of a big deal and the second taking of the oath was just, as the White House lawyer put it, “out of the abundance of caution”. But it is refreshing to see that Obama doesn’t attach much important to religious pomp and ceremony.”

    Obama and Chief Supreme Court Justice John Roberts had both seemingly stumbled over the 35-word oath during Obama’s swearing-in as president on Tuesday, leading some to question whether he had properly committed the Constitutionally-mandated speech act that made him president of the United States.

    A president is required by the Constitution to say: “I do solemnly swear that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”

    At the inaugural, Roberts had mixed up the words, saying instead: “…that I will execute the office to President of the United States faithfully…”

    And so, at 7:35 p.m. today, according to the White House pool report, Roberts re-administered the oath in the Map Room of the White House.

    Obama stood and walked over to make small talk with a reporter as Roberts donned his black robe.

    “Are you ready to take the oath?” Roberts asked.

    The private swearing-in ceremony, sans Bible, took 25 seconds.

    After a flawless recitation, Roberts smiled and said, “Congratulations,
    again.”

    “Thank you, sir,” Obama replied, to a smattering of applause.

    “All right,” Obama said. “The bad news for the pool is there’s 12 more balls.”

    He’s not the President, lack of a bible disqualifies the second oath as was the first that was improperly administered. To assume that no bible was available in DC is to assume that most Americans are morons. People that posted here and didn’t note this discrepancy, are part of the problem and support usurpation.

    Beyond this fiasco lies the simple fact that dual allegiance is a disqualification for the office. His British citizenship conferred through his father makes him a usurper and guilty of fraud, treason and conspiracy to undermine the office of the President. British citizenship cannot be relinquished.

    The Dems new he was not qualified and promoted the fraudulent takeover by their puppet. They forced McCain to be vetted and gave this moron a pass! Couldn’t be an evil agenda in play, now could there!

    i remember seeing this on fox news.. i remember cause it really pissed me off.. why?

    because i do not believe the usurper is a christian to begin with and would have had to be sworn in on the bible..

    this is why roberts screwed up the swearing in…. deliberately i believe… then they went into chambers where obama again took the “correct:” oath but if memory serves me correct of what was shown on fox news there WAS NO BIBLE present..

    this really concerned me but i didnt know what to do .. maybe contact fox news archives?

    Justice Roberts felt that the swearing in on the 20 was flubbed and they did a do over. But–the second, correct do-over was without a bible. To this day, Obama is not a properly sworn in president!!!!!!!!!!!!!!!!!!!!!!!!!!!

    Neither of the swearing in ceremonies actually legit. He swore in as BHO not BHO II or JR. Unless his dead father was elected and we didn’t know it. Biden swore in as JR. I love the fact he bum fuzzelled the first one giving you an open door to walk thru Orly. Bravo and check mate again. Brilliant.

    The Constitution, that document that each and every one of you claims to support, does NOT require the President to be sworn in on the Bible. Teddy Roosevelt did not use a Bible. John Quincy Adams used a lawbook. LBJ used a Catholic Missal. There were several who took the oath in private. The President becomes the Presiden at 12 p.m. on Jan 20th – with or without the oath. He/She just cannot take action as President until the oath is taken.

    you contradict yourself. If the president cannot take any action until the oath is taken, then he is not a president until it is taken, he is just a smiling puppet on the TV screen. If he took an oath and perjured himself, got sworn based on fraudulen information, he needs to be prosecuted and imprisoned for it
