Last week, I heard from constituents in Huntington Beach that were concerned another home was being transformed into a sober-living flop house right next to an elementary school.
Unfortunately, this is a story being told over and over.
Corporations are abusing the Americans with Disabilities Act (ADA) as local governments have had their hands tied, allowing unscrupulous operators to flood our communities with these facilities without regard to the safety of our families and the impact on the quality and character of our neighborhoods.
That is why I have authored House Resolution 5724 — the Restoring Community Oversight of Sober Living Homes Act of 2018. My bill would amend the Fair Housing Act to specify that nothing in federal law “prohibits any state or local government from implementing laws, regulations or ordinances that apply specifically to recovery facilities located in residentially zoned areas.”
This week the House Judiciary Committee will take the next step in the process by holding a hearing on my bill. I have submitted statements from dozens of constituents and solicited testimony from Erik Peterson of the Huntington Beach City Council. This legislation is a priority for me.
