States question Obama citizenship with legislation

ATLANTA — Georgia is the latest state to propose legislation that questions whether President Barack Obama was born in the U.S., joining 10 other states who have measures that want more proof before his name is put on the 2012 ballot.

Even though Hawaii officials have repeatedly confirmed Obama’s citizenship, his birth certificate has been made public and courts have rebuffed challenges, the so-called “birther” issue hasn’t gone away.

Georgia Rep. Mark Hatfield, a Republican, said he still doesn’t know if Obama is eligible to serve as president, and 92 of his GOP colleagues and one Democrat support the bill introduced Monday.

“Most people feel it’s an issue to a significant enough portion of our population that it needs to be addressed by the state,” Hatfield said. “It is, in a sense, a response to … the sitting president and his inability or unwillingness to release his original birth certificate.”

So-called “birthers” have contended since 2008 that Obama is ineligible to be president. They argue he was actually born in Kenya, his father’s homeland. They have also not been satisfied with the “Certification of Live Birth” Obama has released, which is a digital document.

Hatfield’s bill would require a certified copy of Obama’s original birth certificate be provided.

University of Georgia political scientist Charles Bullock said the issue was likely more about politics.

“It could be that this individual really does doubt that Barack Obama was born in this country, despite evidence to the contrary,” he said. “There are also people who think we have never sent astronauts to the moon. Or, the legislator may not have any real qualms, but figures this may play very well with his constituency in the district back home.”

A handful of states, including Georgia, have proposed similar bills since Obama was elected, but five more states joined them during the current legislative session.

“This attention to the citizenship of presidential candidates is a fairly new issue that I’m seeing more of this year,” said Jennie Bowser of the National Conference of State Legislatures.

In Georgia, state Rep. Calvin Smyre, an Obama supporter and former president of the National Black Caucus of State Legislators, was exasperated.

“I thought we had gotten that behind us as a nation. I think that’s a step in the wrong direction,” Smyre said.

Top Republican leaders, including former vice presidential candidate Sarah Palin and House Majority leader Eric Cantor, have also said Obama’s citizenship is not an issue.

A Georgia House committee was expected to take up the proposal this week, and there’s already enough support to pass that body. The Senate’s approval is less clear.

“It is unfortunate that some people continue to fight the Civil War,” said Senate Minority Leader Brown. “We should learn from history that this kind of behavior is bad for business. It’s bad for the image of the state and at the end of the day, it doesn’t accomplish anything.”

The 10 other states with pending bills include: Arizona, Missouri, Nebraska, Oklahoma, Texas, Connecticut, Indiana, Nebraska, Tennessee and Maine. The measure has failed this year in Montana.

    Once again they focus on Mr. obama’s citizenship when the fact of his father being a British Subject makes Mr. obama ineligible to be President because the Constitution requires that the President be a Natural Born Citizen. Mr. obama cannot be a Natural Born Citizen since his father was never a citizen of the U.S.A. and Mr. obama was born a British Subject himself.

    We now have a British Subject sitting in the White House playing at being President. Our Founding Fathers are rolling over in their graves. We fought a war in 1776 to kick the British out of the U.S. and now they are in the White House.

    April Hunt is reporting that a Georgia House Republican, backed by 93 other lawmakers, proposed a law that would force presidential and vice presidential candidates to prove their citizenship before landing on the Georgia ballot.

    Like that’s a bad thing?

    House Bill 401 would not allow a candidate on the ballot until the Secretary of State receives “adequate evidence of such person’s eligibility for election” to those offices. The bill’s sponsor is Mark Hatfield, R-Waycross, but has huge backing with other GOP members.

    “I think the issue with our sitting president has been left unresolved for a significant length of time that people have concerns,” Hatfield said. “But this is not just about our current president. It’s about enforcing the constitutional provisions for anyone who seeks the office of presidency.”

    The proposal is a slight change from a similar bill from Hatfield last year. That bill would have required presidential candidates in Georgia to file an affidavit swearing to be a natural-born citizen.

    Both measures are inspired by the “Birther” movement that believes Barack Obama was not born in the United States. The claim has been widely disproved when Hawaii released records of Obama’s birth, but it remains a popular sentiment among some factions.

    There’s the propaganda.

    There is no such thing as a “Birther” movement. There are many issues, but the bottom line is that Birthers want Obama to document his constitutional eligibility. Some Birthers believe Barack Obama was not born in the United States, others believe he was — where he was born isn’t the issue — the issue is how a British subject and citizen of Kenya can be President of the United States.

    “The claim has been widely disproved when Hawaii released records of Obama’s birth” — no, no, no! Hawaii refuses to confirm that they released Obama’s COLB. That statement is a bold faced lie and pure propaganda.

    Hawaii HAS SAID they did not release records of Obama’s birth.

    Hatfield said he describes himself as a Constitutionalist not a “Birther” but believes that evidence of Obama’s birth has never been made public — a true statement.

    “We’ve seen a computer-generated summary of a live birth but not the particulars of his birth on a long form,” Hatfield said. “Congress has never created an enforcement mechanism, so it is up to the states to step up and fill the gap.”

    If the measure passes both houses of the General Assembly, it would fall to Gov. Nathan Deal to sign into law, which he will do in a heartbeat.”
