How is he wrong? Clearly a tariff is a tax. The solution is either to change the law or to use other provisions that allow tariffs.

it is not a tax, as the company can simply move to US and will have a zero tariff, no tariff, it is a presidential policy

A tariff is a levy on goods entering the US and it’s paid by the US importer, not the exporter.

Almost never. Chinese law forbids it as does Canadian if it’s a Canadian company. And if the company is US-owned the end result is the same. A tariff is a tax. I’m sure the SCOTUS conservatives will tie themselves in knots to let Trump do this but they will still say it’s a tax.
