In Compliance with Rule 616-1-2-.16 (2) Plaintiffs herein by and through their Counsel request this Honorable court to extend time allocated to answer to the motion by the Defendant.
ARGUMENT
Rule 616-1-2–.16 (1) sets the time to answer the motion to 10 days. Plaintiffs were served by the Defendant with a motion to dismiss on Friday, December 16, 2011. The time to respond to this motion is therefore on December 26, 2011.
Rule 616-1-2-.16 (2) allows the Administrative judge in his own discretion to extend time to answer the motion.
Plaintiffs request an extension of time to answer the motion at hand until January 7, 2012.
There is a good cause for extension of time, due to the fact, that the opposition to motion to dismiss is due right after Christmas. Due to the Christmas holidays and vacations attorney for the Plaintiffs would not be able to obtain documents necessary to properly respond to the motion at hand. Additionally, attorney for the Plaintiffs has to submit pleadings in several cases in several states within the same period of time, which represent a significant hardship.
Based on the above, Plaintiffs respectfully request an extension of time until January 7, 2012.
Additionally, a Presidential candidate from American Independent Party, Nationally syndicated talk show host, Ms. Laurie Roth, requested to be joined as an additional plaintiff in the case at hand, rather than file a separate case.
Current complaint was filed on behalf of a registered voter in the state of GA, as well as three presidential candidates from Democrat and Republican parties, all of whom are seeking an injunction and declaratory relief, seeking Presidential candidate from the Democrat party, Barack Obama, to be Constitutionally ineligible to be on the ballot, due to his citizenship in three other countries, due to the fact, that he is using a last name, which is different from his legal name, listed in his mother’s passport and his educational records and due to the fact that he does not have valid identification papers. Social Security number he is using in his tax returns and his Selective Service documents was not assigned to him according to E-Verify and SSNVS and a copy of the long form birth certificate, that he posted on WhiteHouse.gov, represents a computer generated forgery, created approximately 5 minutes before it was provided to the public and not some 50 years ago. Presidential candidate Roth is represented by the same attorney Orly Taitz, has the same claims against the same defendants, and in the interest of judicial economy it would benefit all the parties, for this court to exercise its’ inherent powers and discretion and allow Ms. Roth to join the plaintiffs in the case at hand, rather than file a separate complaint.
SUMMARY
Due to all of the above, Plaintiffs respectfully request extension of time to answer to the Defendant’s motion until January 7, 2012 and for the court to use its’ discretion to add presidential candidate Laurie Roth as an additional Plaintiff.
