Dr. Taitz,
Here is my guess as to what is going on.
I think 3 justices voted to hear
kerchner vs Obama Writ of Centori.
Roberts, Alito and Scalia.
Chief Justice Roberts does not want to put your appeal up for conference and have it denied. What would be the point.
I am guessing that he is trying to get
5 votes that would approve the Writ of Centori
before he posts it for conference.
That is what I would do.

Alito, really? The same Samuel A. Alito, Jr. who testified before the Senate, “I don’t think that it’s appropriate or useful to look to foreign law in interpreting the provisions of our Constitution.” THAT Alito?

Alito, Yes. The same Samuel A. Alito, Jr. that recognizes that the US has it’s own Constitution, Bill of Rights and our own federal laws that govern the US. That Alito.

Since Alito rejects use of foreign law to interpret the U.S. Constitution, he’s not going to be very receptive to that Vattellite argument. That leaves you with Roberts, Thomas and Scalia — only three justices, when you need four.

it is true, that Alito is not receptive to international law arguments, however there is more, than just Vattel. Additionally other justices, such as Kennedy or Bryer might be receptive to hearing the argument, as it involves one’s right to legal representation. We’ll have to wait and see
