    Question: How could 45% of the Senate be kicked out when only 33% of the Senate is up for election every two years, as per the Constitution?

    because some resign before their term is up

    Actually, Dr. Taitz, in 1980, Republicans gained twelve Senate seats. Of those, three were open seats and nine held by incumbents. That is actually 12% not 45%.

    I did not say Republicans only. That year was the year of the least reelections of incumbents in Senate, from both parties. I did not come up with the data, I only posted the data from the survey
