HUGE NEWS! Fed. Judge Carter sets Trial Date for Obama’s Eligibility!!!

The expedited trial has been set for Jan. 26, 2010, just 4 1/2 months from now!
 
I and many other concerned veterans and citizens attended the hearing today in Federal Court in Santa Ana in the lawsuit against Barack Obama to determine his eligibility to be President and Commander in Chief.  About 150 people showed up, almost all in support of the lawsuit to demand that Obama release his birth certificate and other records that he has hidden from the American people.
 
Judge David Carter refused to hear Obama’s request for dismissal today, instead setting a hearing date for Oct. 5, since Obama’s attorneys had just filed the motion on Friday.  He indicated there was almost no chance that this case would be dismissed.  Obama is arguing this lawsuit was filed in the wrong court if you can believe that.  I guess Obama would prefer a “kangaroo court” instead of a Federal court!  Assuming Judge Carter denies Obama’s motion for dismissal, he will likely then order expedited discovery which will force Obama to release his birth certificate in a timely manner (if he has one).
 
The judge, who is a former U.S. Marine, repeated several times that this is a very serious case which must be resolved quickly so that the troops know that their Commander in Chief is eligible to hold that position and issue lawful orders to our military in this time of war.  He basically said Obama must prove his eligibility to the court!  He said Americans deserve to know the truth about their President!
 
The two U.S. Attorneys representing Barack Obama tried everything they could to sway the judge that this case was frivolous, but Carter would have none of it and cut them off several times.  Obama’s attorneys left the courtroom after about the 90 minute hearing looking defeated and nervous.
 
Great day in America for the U.S. Constitution!!!   The truth about Barack Obama’s eligibility will be known fairly soon – Judge Carter practically guaranteed it!

A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama’s eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.

If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.

In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.

    Thanks for the detailed update Jeff! Its nice to get the news from a patriot that is not putting a ‘spin’ on every activity. This is VERY exciting news!! God Bless Judge David O. Carter for his strength and courage through all the outside pressures to honor his oath to our country and to God!! Way to go ORLY!!!!

    Don’t leave the motion to dismiss to chance. File a smashing response to be sure Judge Carter will deny the motion to dismiss. File many amicis briefs with the court urging against dismissal.

    Obama is arguing this lawsuit was filed in the wrong court if you can believe that. I guess Obama would prefer a “kangaroo court” instead of a Federal court! I am with you on that, but PLEASE listen to this commentator on patriotsheart radio. Rod Class tells why every lawsuit has been dismissed. He tells why a person cannot bring lawsuits against the government because of the “wrong court” and the “standing” issue. He describes in great detail the little court called the Superior Court of the District of Columbia on Indiana St. and how he managed to provide the proper paperwork in the proper court. The audio is lengthy, but had me riveted. If true, it is a real shocker!

    Good to hear that this case may be going to trial. Does this one mention the issue of Obama’s British citizenship at birth? I hope so; that’s a solid legal argument, especially with all of the material Leo Donofrio has been publishing lately on his blog.

    Orly, I’m concerned that Judge Carter has effectively given Obama’s goon lawyers a “heads up” by setting a court date for 10/5 and 1/26. Did he address the possibility that the goons will immediately get to work and destroy evidence? Did he put a”freeze” so to speak, on accessing files and evidence?? I just don’t trust Obama’s thug lawyers.

    This was great news. Yes, the UCMJ demands that fraud perpetrated by a superior officer MUST be reported. Obama’s claim of being a Natural Born Citizen in F.E.C. and state election forms is that fraud.

    If Judge Carter finds the Political Questions Doctrine problematic, Ms. Taitz can temper the language with a pleading ‘in the alternative;’ alleging Obama’s ineligibility in the main complaint, but in the case of restrictions due to the Political Questions Doctrine a seperate plea in the alternative for a simple Definition of Natural Born Citizen. Fed. R. Civ. P. 8(e)(2)

    The judge is then free to request Amicus Curae on the subject and publish a holding. The correct definition of NBC would be from his due diligence from the briefs, and he would not directly overturn an election.

    The resulting opinion stating the Def. of Natural Born Citizen could then be taken up by a caucus in Congress, and they have the constitutional power to investigate the issue.

    Go Orly!!! The US Attorneys have a conflict of interest and should be thrown off of the case!!! They work for us and should be the one filing the law suite!!! The judge needs to kick them out!

    There is nowhere in the Constitution that states the US Attorneys are any resident of the White House own personal free legal team.

    In that, Orly Taitz should be demanding of the Judge as should the Judge in California that the US Attorneys get out of court as it is a conflict of interest in their defending Bearick Obama against the people of the United States who they are sworn to defend.
    Ms. Taitz should be demanding that Mr. Obama in this private matter produce private attorneys and that the US Justice begin proceedings to assist her cases against Citizen Kenya.
    The Judge should have thrown those US Attorneys out the first day and ordered Obama to produce his own counsel or the Judge would rule immediately for Obama’s records to be released in full to the American people.

    i’d like orly taitz to meditate one sentence amidst her hectic agenda
    in the bible (i’m not a christian so relax) it says : “the antichrist cannot be defeated by human means (everything orly taitz does is “human”) by only by divine means”

    Why is the DOJ representing Obama? Since thjis case is about Obama’s eligibility to be president and not a state matter the DOJ should not be involved in Obama’s case other than exercising the orders of the court once the case has been concluded and judgement rendered. This is Obama’s personal issue based on his usurping The Office of President of the United States; the other defendants have a right ot DOJ representation since their offical government duties are at issue in this matter. Only my thoughts.

    I am very proud of the people involved in forcing this issue. I believe he will not be able to produce a birth certificate, although it is my understanding that if there are witnesses to the birth, their word can hold as much weight as a birth certificate document. Whatever “witnesses” Obama’s attorneys subpoena need to be thoroughly examined along with their bank records because I can’t believe that if he truly were born in the US that they people wouldn’t have been SHOUTING his citizenship LONG AGO.
