Major Hasan’s killing spree shows the huje problem with the Judge Carter’s statement about necessity for soldiers to follow orders even if there is no guarantee that higher officer giving these orders has constitutional rights to give them. What if major not only kill people himself, but also ordered a dozen of soldiers and lieutenants to open fire. According to Judge Carter’s ruling soldiers had to obey the command given by major. And they would have no rights to question these orders in a court, because it would be interference with the military affairs. Even more… If Major Hasan would dress himself into a uniform of a 5 star General, he would instantaneously obtain a right to order an artillery shelling of some US city. Judge Carter would call on soldiers to obey command of the guy dressed as a General, because that guy was allowed (guard fell asleep) to reach the direct phone line. Judge Carter would never order to remove that phony general from the chain of command criminal had no rights to hold to begin with. |
