   Orly,
   You did a great job. You really got Asst Sec of State when you said “would you put me on the ballot”. That might be the best argument ! The only other argument you could have made is this. The commission has the duty to see if the paperwork is in accordance with all state laws, not just the section about the filing fee and the declaration of candidacy. The commission only looked at one section of the law. Last time I checked, fraud was against the law too !!

   There is a scripture about what

   Good job, I would have also cross-examined the Asst Sec of State, particulary on the issue of the declaration. A declaration must comport with the state laws, however, when that declaration is challenged what procedures are conducted. A mere declaration submitted by Mr. Biden instead of Obama does not comport. You are correct the burden shifts. I bet if you had a copy of a declaration from someone who signed and dated the form and presented that on cross as an example to the Asst. Sec. of State his answer would have still been in the affirmative. Question Asst. Sec. what steps are taken to ensure that the signed declaration is true? What if the declaration is challegend, what is the policy of your office? How can you attest that the declaration signed is the actual signature of the person named on the declaration? What steps and procedures does your office do to ensure that each and every individual is qualified to be placed on the ballot. Are you aware that even illegal aliens have obtained and used social security numbers? If so what measures were take or investigations were conducted? The declartion is signed under the penalty of perjury, what is done to ensure that the information contained on the declaration is true? The first time Mr. Obama ran for office in 08 you did not have a birth certificate to view corret? The first time Mr. Obama ran in 08 you had not viewed his signature prior to the one on the declaration? What safeguards are in place to ensure the candidate is qualified? Has this happened in the past? If so what measures were taken? What is your burden to prove or disprove a citizens complaint regarding a candidate? There is a a law to enforce the penalty of perjury correct? Who enforces this law? What measure are taken to ensure perjury has not occured? Do you do that with each candidate? If not why?
