In other words, the Joint Chiefs are chicken livered cowards?

How can they dare send our men and women into harms way, if they don’t even have a drop of integrity to keep their promise to uphold the constitution?

Shame! and this on the eve of the 4th of July!

I was afraid that the Sec. 138 complaints were off-target. However, I view it as good news that the JAG officer sent it “up the food chain” in his own department for review. We’ll see what happens. I think it is premature to say “shame” just yet.

I am not a lawyer nor am I any kind of expert in matters of law but as I read his letter I was struck by his lack of recognizing the ‘Commander in Chief’ as a military officer who can be subject to a 138 grievance. Correct me if I am wrong, but I have to agree with Gary’s comment above that he is passing the buck. I just hope the person he passes this to will take it seriously.

Orly, it occurred to me that virtually every nation has a serious, pressing reason to challenge Obama’s eligibility. They are all suffering from the fallout of the economic damage he has done to America. Virtually every country is being impoverished by Obama’s policies.

I know you could make governments worldwide realize that if Obama and his complicit Congress were REMOVED from the United States government, economic policies could be reversed and the impoverished countries could then recover and thrive.

But the big question is: Once government representatives understand/comprehend that globally, is there a legal way for them all to band together in a class action suit against Obama and Congress?

Orly, the Obama regime has now implied that the years of our military’s sacrificed lives — the time they served, their battling, their injuries, their deaths — in Iraq will have been for NOTHING.

[[ Vice President Joseph Biden told Iraqi leaders that . . . the U.S. might disengage from their country if it reverts to sustained violence. ]]

How many American military members are willing to let Obama desert Iraq?

Bottom line is if the chairman of the joint chiefs does not challenge an order given there is nothing that can be done except charge him with treason should Obama be removed by another branch of government. Since the congress and courts are apparently unwilling to even investigate the matter or acknowledge it at all there is a good reason for the chairman and every other elected official to ignore the accusations, they are able to claim ignorance as a defense should they be tried later on. Serving them makes that impossible and sooner or later there will either be a change of heart by those wishing to save their arses or the conspiracy will tighten to suppress it. Right now the suppression is working but it is weakening as more and more unconstitutional acts are exposed and awakens the publics interest as to what this man really is doing and questioning what his end game really is. There is a pattern that does not fit the claim that he is protecting Americans but rather fits the historically patented hoarding of power by a tyrant.

I think that Israel would be the most likely country to go to the World Court. The Israeli government may not know about this option. Would be nice if someone could let them know.
Obama hates the Jewish people. For that reason, Israel has a reason to want to do something as soon as possible to save their country from Obama’s pro-Muslim policies.

    Dear Orly,

In the FY 2007 Military Authorization Act paragraph (a)1(0 ) of Article 2 Sub Chapter 1 (General Provisions) of the UCMJ was amended by Congress. Article 2 deals directly with defining those that are subject to the UCMJ.

The paragraph now reads, “In a time of declared war or a contingency operation, persons serving with or accompanying an armed force in the field.”

United States Code Title 10 defines “contingency operation” and both the Iraq and Afghanistan Theaters qualify.

The law makes no provision excepting ANY person or action. BHO IS a person, just not a very good one.

BHO has visited both theaters and met with with the military commanders in private meetings in both theaters. Any order issued by the CINC, even a confirmation of previous orders, such as redeployment, that affects any Article 138 complainant would subject BHO to the UCMJ under their complaint.

The CJCS would be well aware of this as would Captain Crawford. Even though it is an unintended result of the amendment, it is still a result.

It took over 2 months to respond to you. These men are very well trained and experienced in exploiting weaknesses and not exposing their own. They have the duty to uphold and defend the Constitution and the authority under the UCMJ to act and they do not. There is no indication in Captain Crawford’s reply that the Chairman, who is also the C.O. of the Office of General Counsel, has issued any order to that office. He merely sent the dossiers for review. He did not tell them to contact you, he did not direct them to contact the Attorney General, he did not tell them to prepare a warrant for the arrest of BHO.

These men have a sworn duty to uphold and defend the Constitution, the Supreme Law of the Land, which is supposed to trump the UCMJ. If it no longer does in the eyes of the Joint Chief’s and their legal counsel then it is time for us to dig in! If the Attorney General will not act, the Congress will not act, and the Courts will not act it is incumbent upon the military to act! It appears that they too, are betraying their oaths. I am ashamed that such cowards and traitors are among the ranks of our Armed Forces! THEY should be the chief complainants in the court actions that you and others have filed. There should be no higher priority to them then to establish that the CINC is legitimate and the Constitution, and therefore the republic, is intact. Anything else IS cowardice and treachery.

There is no other conclusion,Counselor, then that the delay in responding to you and the passing to the Office of General Counsel “for review” is just more subterfuge, complicity, and treason.

    Semper Fi,

    Todd C. Salzer

While it is encouraging that the information has been sent from the office of the Joint Chief’s of Staff (i.e. legal counsel) to the DOJ…it is also passing the buck by saying that the Commander in Chief of the military itself is now a : “3rd party senior government official.” They ALL find some way to pass the buck. NOBODY want’s to deal with what they know themselves to be a very critical Constitutional question.

Perhaps the way to file Article 138’s is to question the mission that a “Commanding Officer” has given by saying something like….it’s believed this mission, or this deployment isn’t Constitutional because the Commanding Officer is receiving orders from an unproven Commander in Chief. Maybe the Commanding officer can be questioned as to weather they believe Barry has proven to be Constitutionally fit to be POTUS. Let them explain how they believe he’s qualified. If they don’t, then they too should question on up the chain.

The preferred involvement of the military is to stick to their oaths and refrain from becoming involved in the suppression of civilian protest. However, to insure that it is becoming clear that the National Guard and Reserves, being composed of people with more of a clear cut loyalty to their people and the country, need to be made aware of what is going on and to be ready to stand up and oppose any potential actions by the regular services. This is the price we are paying for encouraging a full time ‘professional’ military who’s allegiance may not be to their oaths but to their ’superiors’. This is the reason I have never been against the draft – the military of the Vietnam era could never have been induced to blindly follow orders as there were too many draftees. Unfortunately times change.

We are not going to get out of this by whistling in the dark and begging foreign governments to save us. Don’t you understand that this is a world wide movement that already has its tentacles locked in control of most of the Western world – we are the last to be pulled down. This will be won by the average citizen when they understand what is going on and take the necessary steps to reverse the corruption from the bottom up. Take control at the county level, then the state level, and the rest will follow.

I don’t see the courts or any federal governmental office doing anything because our political process was taken over by the wealthy interests a long long time ago, and there hasn’t been a whiskers difference between the so called Democrat and Republican parties in generations. When you understand that for all practical purposes all our political offices are controlled between these two supposedly different parties you should get an idea of the problem. This won’t be solved until these parties have been banned and their controllers tried and convicted for treason.

The importance of Dr. Taitze’s fight isn’t that it’s going to result in a resolution of this mess by the courts, but lies in creating enough coverage to bring the issues out and make the average citizen aware of what is going on. Our government is in the hands of the corrupt and power hungry, if you think they are going to give up without a fight you are sadly mistaken – we are in the midst of a civil war with the traitors being aided and abetted by powerful outside forces. It’s going to get a lot worse before it gets better.

The Commander in Chief is not one of the “third party senior government officials.”

Is Crawford saying in his letter to you that the relationship between a civilian Commander in Chief (Obama) and military personnel is not governed by Article 138 of the Uniform Code of Military Justice? Where in that code does it exclude military orders issued by the President from its jurisdiction. A military order is a military order.

Come on patriots. Dig into Article 138 or any other applicable body of law and find how to enforce the law.

I have been for the draft for many years as it provides people in the military who do not really want to be there and who are more willing to speak up when something is wrong unlike the career minded suck ups.

Have draftees in the military provides a check and balance function that we do not now have.

How difficult is it to arrest the White House resident, the members of Congress, the Senators, the AGs from every state, every Supreme Court Justice, and every other person complicit in these treasonous acts…WE THE PEOPLE must remove them all NOW!!!!
