Um, Orly? Have you read the Supremacy Clause? Clearly the Texan who pre-filed this bill has never taken a moment to read the Constitution. If enacted, it will never survive legal challenge.

Orly, you’re a lawyer. How about you explain for the non-lawyer types who read this blog exactly how Berman’s bill would actually work. Explain, please, (1) what “enforcement” of Patient Protection and Affordable Care Act would bring federal agents to Texas to do their work, (2) how Texas state government attempts to prosecute these federal agents for crimes would be carried out, since federal employees are granted immunity while carrying out the duties of their jobs, and (3) how Texas state courts would retain jurisdiction over criminal prosecutions given that the defendant would have the right to remove the case to a federal court.

Thank you in advance for your detailed legal analysis of this proposed legislation.

do we have some one from Leo berman’s district (Tyler, TX) posting on this blog? I need to get in touch with him and get the actual wording. So far I have only a summary from Bob Unrue

Your readers are particularly interested in how Sections 392.005 and 392.006 will be carried out. Please explain it to them, Orly.

Orly:…why don’t we ask politi-commie to investigate and post the results of his research, himself, instead of throwing this at you? This person just wants to “stack it on you,” Orly!

I wouldn’t concern myself with his “obnoxious” request! This (guy-?) is a “smart-ass” for having the gaul to post this way on YOUR SITE, Orly! He knows he’s playing a “game” of “intimidation” with you!
If he knows so much, he should come up with “all” the facts and figures, instead of trying to “pawn this off” on you! And…does this type of post “reveal” and/or “look familiar” to you, Orly? Hmmm…!
