Court:  Illegal aliens can get in-state tuition

SAN FRANCISCO — The California Supreme Court says some illegal immigrants are entitled to the same tuition breaks offered to in-state high school students to attend public colleges and universities.

The high court unanimously upheld a state law that says any student, regardless of immigration status, who attended a California high school for at least three years can qualify for in-state tuition rates.

A lower court had ruled the law unconstitutional. It said the law violated federal prohibitions denying illegal immigrants secondary education benefits that aren’t offered to U.S. citizens.

The high court reversed that decision Monday, noting that the benefits at issue also are offered to U.S. citizens.

 
 
 
The California Supreme Court decided unanimously Monday that illegal immigrants may continue to be eligible for in-state tuition rates at the state’s colleges and universities rather than pay the higher rates charged to those who live out of state.

In a ruling written by Justice Ming W. Chin, one of the panel’s more conservative members, the state high court said a California law that guarantees the lower tuition for students who attend California high schools for at least three years and graduate does not conflict with a federal prohibition on giving illegal immigrants educational benefits based on residency.

California is one of several states that permit illegal immigrants to take advantage of lower college tuition for students who attend high school and graduate in state. About 25,000 illegal immigrants are estimated to receive in-state tuition rates in California.

A group fighting illegal immigration challenged the California law on behalf of U.S. citizens who pay the higher tuition as out-of-state students. The group won in lower court, and the state appealed.

The lawsuit contended the California law usurped a federal prohibition on giving educational benefits based on residency to illegal immigrants but not all U.S. citizens.College students who are in the country illegally are barred from government financial-aid programs. The U.S. Supreme Court is expected eventually to decide whether the lower tuition rates also violate federal law.

[Updated at 10:29: The court observed that the state law also benefits U.S. citizens who reside in other states but attend and graduate from high school in California.

    Orly:…Boy, giving illegals help for college! It appears that you folks must do what people in Iowa did here: get a question on the ballot and ask if any (supreme court judge) should be “retained?” The people in Iowa spoke “loud and clear!”

    They voted (OUT) all 3 judges who were up for retention and who voted for this immoral law as it relates to “same sex marriages!” They don’t mess with words here! And have sent emails, texts, but have not heard from you. So it appears that these treasonous types are still active!

    “President Obama must decide now how he wants to govern in the two years leading up to the 2012 presidential election.

    In recent days, he has offered differing visions of how he might approach the country’s problems. At one point, he spoke of the need for “mid-course corrections.” At another, he expressed a desire to take ideas from both sides of the aisle. And before this month’s midterm elections, he said he believed that the next two years would involve “hand-to-hand combat” with Republicans, whom he also referred to as “enemies.”

    It is clear that the president is still trying to reach a resolution in his own mind as to what he should do and how he should do it.

    This is a critical moment for the country. From the faltering economy to the burdensome deficit to our foreign policy struggles, America is suffering a widespread sense of crisis and anxiety about the future. Under these circumstances, Obama has the opportunity to seize the high ground and the imagination of the nation once again, and to galvanize the public for the hard decisions that must be made. The only way he can do so, though, is by putting national interests ahead of personal or political ones.

    To that end, we believe Obama should announce immediately that he will not be a candidate for reelection in 2012.

    If the president goes down the reelection road, we are guaranteed two years of political gridlock at a time when we can ill afford it. But by explicitly saying he will be a one-term president, Obama can deliver on his central campaign promise of 2008, draining the poison from our culture of polarization and ending the resentment and division that have eroded our national identity and common purpose.

    We do not come to this conclusion lightly. But it is clear, we believe, that the president has largely lost the consent of the governed. The midterm elections were effectively a referendum on the Obama presidency. And even if it was not an endorsement of a Republican vision for America, the drubbing the Democrats took was certainly a vote of no confidence in Obama and his party. The president has almost no credibility left with Republicans and little with independents.”
