Can someone get in touch with governor Brewer?

Posted on | June 19, 2010 | 3 Comments

There is a serious concern about legal challenges against AZ immigration.

A couple of legal actions were filed in the Federal court in AZ challenging this law. i just heard on FOX that gov Brewer is waiting for the federal judge to decide.

I am extremely concerned. Her best bet and best assurance of impartiality, is to demand a jury trial on all issues of fact and law, not to leave it in the hands of a federal judge. Another option is to file a motion to remand the case to the state court, since the law concerns the state statute.

There is an inherent conflict of interest. The Federal judge gets his salary from the federal government, which already announced through Hillary Clinton, that it intends to sue. I wonder if Hillary’s press conference in Ecuador was a message to the presiding judge. If the presiding judge refuses to grant AZ’s motion to have all issues of fact and law decided by the jury, they should not submit to further litigation by this judge, but rather seek to recuse the judge or motion to remand to the state court  or file an interlocutory appeal. Governor of AZ should not submit to the Federal government tyranny.  Can someone help me get in touch with Jan Brewer?

Orly, once again I’m concerned you don’t understand the law very well. Every first year law student knows that juries do not make judgments of law — only fact. When a law is challenged as unconstitutional, it is by definition a matter decided by a judge. Juries have nothing to do with it.

no, you are wrong! there is nothing in our Constitution giving the judges the exclusivity on deciding the matters of law.Jury needs to be apprised of what the law is, what is in the Constitution and they can decide, if the Constitution was violated.
